Welcome to Solstaya! The terms "we", "us" and "our" refer to Solstaya, operated by Solstaya L.L.C., a limited liability company registered in Wyoming, United States. Solstaya operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). Solstaya is powered by Shopify, which enables us to provide the Services to you.

The terms and conditions below, together with any policies referenced here (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services. Please read them carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy policy. If you do not agree, please do not use our Services.

By agreeing to these Terms, you confirm that you are at least the age of majority in the state where you live, and that you consent to any of your minor dependents using the Services on devices you own, purchase or manage.

3. Product use and installation

Please read and follow any instructions, warnings and installation guidance supplied with your products. Lighting should only be used with the power supply and bulb type stated on the product page, and hard-wired lighting should be installed by a qualified electrician. Do not modify products or use them for purposes they were not designed for.

4. Orders

When you place an order, you are making an offer to buy. We may accept or decline your order for any reason. Your order is accepted only when we confirm it by email, and we must first receive and process your payment. Please review your order carefully before you submit it. If we do not accept, change or cancel an order, we will try to let you know using the email, billing address or phone number you gave us.

Your purchases are subject to return or refund only in line with our Refund policy.

Your purchases are for your own personal or household use, not for commercial resale or export.

5. Prices and billing

Prices, discounts and promotions can change without notice. The price charged is the price in effect when you place your order, shown in your order confirmation email. Prices are shown and charged in US dollars (USD). Shipping costs and taxes are explained in our Shipping policy.

You agree to provide current, complete and accurate payment and account information, and to update it promptly if it changes so that we can complete your transactions and contact you when needed. You confirm that the payment details you provide are correct, that you are authorized to use the payment method, and that you will pay the charges at the prices shown, including shipping and any applicable taxes.

6. Shipping and delivery

Delivery is described in our Shipping policy. We deliver within the United States only. Delivery times are estimates, not guarantees, and we are not responsible for delays caused by carriers, customs or events outside our control. Risk of loss or damage to your goods passes to you when they are delivered to the address you gave us.

7. Returns and refunds

Returns and refunds are governed by our Refund policy. Whatever the problem with your order, please contact us first so that we can solve it.

Shopify's name, logo and related marks are trademarks of Shopify, and all other names and logos on the Services belong to their respective owners.

9. Optional tools

We may give you access to tools offered by third parties, which we do not monitor or control. You acknowledge that these tools are provided "as is" and "as available", without warranties of any kind and without endorsement. We have no liability arising from your use of optional third-party tools, and you use them at your own risk and subject to the terms of their providers. New features we add to the Services are also covered by these Terms.

The Services may contain links to websites provided by third parties. We are not responsible for examining or evaluating their content or accuracy. If you leave the Services to visit those sites, you do so at your own risk. We are not liable for any harm or damages related to third-party websites, or to your purchase or use of products, services or content on them. Solstaya is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Solstaya. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sale between you and Solstaya, including any injury, damage or loss resulting from purchased products and services. To the extent permitted by law, you release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with Solstaya.

All personal information we collect through the Services is subject to our Privacy policy, and some personal information may be subject to Shopify's privacy policy. Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services. 13. Feedback and reviews

If we cancel an order, we will refund any payment you made for it.

We may end this agreement or your access to the Services (or any part of them) at any time if you breach these Terms, and you remain liable for all amounts due up to the date of termination. Sections that by their nature should continue after termination will continue, including Intellectual property, Feedback, Disclaimer of warranties, Limitation of liability, Indemnification, Governing law and Privacy.

The information presented on or through the Services is provided for general information only. We do not warrant its accuracy, completeness or usefulness, and any reliance you place on it is at your own risk.

Except as expressly stated by Solstaya (including our 30-day money-back guarantee), the Services and all products offered through them are provided "as is" and "as available", without any representation, warranty or condition of any kind, express or implied, to the fullest extent permitted by law. We do not guarantee that your use of the Services will be uninterrupted, timely, secure or error-free.

Some states do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. Nothing in these Terms affects any right you have under the laws of your state that cannot be waived.

18. Limitation of liability

To the fullest extent permitted by law, Solstaya, Solstaya L.L.C., our partners, directors, officers, employees, affiliates, agents, contractors, service providers and licensors, and those of Shopify, will not be liable for any injury, loss, claim, or any indirect, incidental, punitive, special or consequential damages of any kind, including lost profits, lost revenue, lost savings, loss of data or replacement costs, whether based on contract, tort (including negligence), strict liability or otherwise, arising from your use of the Services or of any products bought through them. Where liability cannot be excluded, it is limited to the amount you paid for the product concerned.

Nothing in these Terms excludes or limits liability for fraud or for anything else that cannot be excluded or limited by law. Some states do not allow the limitation of certain damages, so some of these limits may not apply to you.

To the extent permitted by law, you agree to indemnify and hold harmless Solstaya, Solstaya L.L.C., Shopify and our affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from any losses, damages, liabilities or claims, including reasonable legal fees, payable to a third party because of (1) your breach of these Terms or the documents they refer to, (2) your violation of any law or third-party right, or (3) your misuse of the Services.

If any provision of these Terms is found to be unlawful, void or unenforceable, it will be enforced to the fullest extent permitted by law, and the rest of these Terms will remain valid and enforceable.

21. Waiver and entire agreement

If we do not exercise or enforce a right or provision of these Terms, that is not a waiver of it. These Terms, together with our Privacy policy, Refund policy and Shipping policy and any rules posted on the site, are the entire agreement between you and us about the Services and replace any earlier agreements, communications or proposals, written or oral. Any ambiguity in these Terms will not be interpreted against the party that drafted them.

This does not remove any consumer protection rights you have under the laws of the state where you live.
